The Competition Board fined Şişecam 3.1 billion TL

The Competition Board imposed an administrative fine of 3 billion 154 million liras on Şişecam. Şişecam announced that they will take legal action against the penalty.

The Competition Board awarded 3 billion 154 million 657 thousand 221 liras to economic integrity including Türkiye Şişe ve Cam Fabrikaları AŞ (Şişecam) and its subsidiary Şişecam Çevre Sistemleri AŞ, Karacalar Nak. According to a statement on the Competition Authority's website, the investigation into the businesses in question has been completed.

Within the scope of the investigation, it was determined that there was a violation of the obligations in the relevant provisions of the commitment package on “limiting the purchase of unprocessed flat glass” and “avoiding any transactions that may cause the commitment provisions to limit the purchase of unprocessed glass products to become dysfunctional”. For these reasons, it was decided to impose an administrative fine of 3 billion 154 million 657 thousand 221 liras on the economic integrity of ŞİŞECAM and its subsidiary Çevre Sitemleri.

The rationale for this decision will be announced later, with legal action open to the Ankara Administrative Court. It was determined that environmental systems and Karacalar violated relevant provisions of the Law on Competition Protection by determining fish and meat prices, sharing regions or customers for the purpose of restricting competition and exchanging competitively sensitive information. The Council decided not to impose an administrative fine on Çevre Sitemleri within the framework of the relevant law, but to impose an administrative fine of 1 million 947 thousand 469.47 liras on Karacalar. The rationale for this decision will be announced later, with legal action open to the Ankara Administrative Court. “WILL IMPLEMENT NECESSARY LEGAL INITIATIVES” According to Şişecam's statement to the Public Disclosure Platform, the amount of fine predicted by the Competition Commission against the company will be 2 billion 365 million 992 thousand 915.75 lira, entitled to a 25% early payment discount. The Company reserves its legal rights to the decision and penalty in question and the necessary legal initiatives will be taken.
